Divorces in Alberta are granted by the Court of King’s Bench under the federal Divorce Act. At least one spouse must have lived in Alberta for the year before the application is filed.
The most common ground is a one year separation, which means you have lived separate and apart for a year. You can start the paperwork earlier, but the court cannot grant the divorce until the year is complete. A short attempt to reconcile, up to 90 days in total, does not restart the clock.
