Civil Litigation Lawyer Edmonton: How civil litigation works in Alberta

Two main courts, one general deadline, and strong encouragement to settle.

Civil claims go to the Alberta Court of Justice for amounts up to $100,000, or to the Court of King’s Bench for larger claims and many complex matters. The Court of Justice has simpler procedures and lower costs, but also lower limits. Claims above the limit can be reduced to fit, which waives the excess.

The Limitations Act generally gives two years from when you knew, or should have known, of the claim, with a ten-year ultimate limit. Missing it can end a claim, even a good one.

Most disputes do not reach trial. Pleadings, document exchange and questioning are followed by settlement discussions, mediation or a judicial dispute resolution conference. Alberta’s Rules of Court require parties to try to resolve disputes before trial.

If you win a judgment, you may still need to enforce it, for example through garnishment or a writ of enforcement. See our debt collection page.
