Employment Lawyer Edmonton: How employment law works in Alberta

Two layers apply: the Employment Standards Code and the common law.

The Employment Standards Code sets minimum rules for notice or pay in lieu of notice when an employer ends employment without cause, based on length of service. After the first 90 days, the minimum starts at one week and rises with service, up to eight weeks for ten or more years.

Beyond the minimum, the common law can entitle a dismissed employee to reasonable notice, often much more than the statute requires. Courts consider age, length of service, the character of the job and the availability of similar work. There is no simple formula.

An employer can end employment for just cause only in limited cases, and the bar is high. Employment contracts with termination clauses are closely examined, and a poorly drafted clause may not be enforceable.

The general deadline to sue is two years. Claims of up to $100,000 can go to the Court of Justice. See our wrongful dismissal and severance package pages.
